    Notice Types

    • Utah has five types of eviction notices. According to the "Utah Renters Handbook" issued by the Utah courts, the notices are the Three-Day Alternative Notice for Non-Payment of Rent and/or Other Amounts Due, the Three Day Notice to Vacate, the Three Day Notice to Comply or Quit, the Fifteen Day "No Cause" Notice and the Five Day Notice to "Tenant-at-will." Each notice has the number of days allowed before you must vacate. However, not all of them give the order to vacate alone. The Three Day Notice to Comply and Quit and the Three Day Alternative Notice for Non-Payment of Rent and Other Amounts Due give you the option to stay if you do as the landlord specifies in the notice.

    Notice Requirements

    • Each notice must be identified as one of the five listed in the "Notice Types" section. Failure to do so voids the notice. The notice must identify both tenant and landlord as well as the reasons for the eviction notice. For example, the Three Day Notice to Vacate can only be served if the tenant is being a disturbance or nuisance to the neighbors, damaging the rental or performing illegal activity out of the rental. On this notice, the landlord must specify the type of behavior that led to the notice and it must be considered illegal, a nuisance or disturbance by the Utah courts.

    Notices and Eviction Timeline

    • The notices are the first step in the eviction process that ends up in court if the tenant does not comply. The landlord sends the notice out as a way to solve the problem without court involvement by getting the tenant out of the property. If the notice is disregarded by the tenant, the landlord must then sue the tenant in civil court for eviction.

    Notice Must Match the Reason

    • Landlords must use the right lease or the eviction notice does not hold up in court. The Three Day Notice to Vacate eviction, for example, cannot be used to to force a tenant to comply with the lease regulations. That notice is the Three Day Notice to Comply or Quit. The Three Day Alternative Notice for Non-payment of Rent and/or Other Amounts Due is used to force a tenant to pay past due rent and fees.
