How to Sue Facebook for Abusive Practices
- 1). Determine the cause of action under state or federal law you intend to pursue against Facebook. In most jurisdictions, "abusive practices" is not a cause of action. Common causes of action for pursuing legal action against Facebook in court include invasion of privacy or bad faith violations of consumer protection laws.
- 2). Research state or federal law to find case law supporting your proposed cause of action. If you have a strong case but no relevant state case law, you may consider looking for convincing precedent from other states.
- 3). Document the harmful practices and wrongs that Facebook has perpetrated against you. Keep a log or a digital recording of these practices so that you can later introduce them as evidence in court. Develop a theory of damages to present in your complaint.
- 4). Draft a complaint in accordance with state, federal and local rules of civil procedure. Be sure to give the basic background facts of your case, an explanation as to how you've been harmed and an explanation as to how your case fits within your state's laws regarding invasion of privacy, consumer protection laws or other abusive practices.
