Prison Sentences for Felony Convictions in NY

Indeterminate sentences: An intermediate sentence has a range of years. There is a minimum sentence, but the release date is not pre-determined. If the convicted person serves the minimum sentence with good behavior, then parole is a possibility.

Determinate sentences: A determinate sentence is definite and unchangeable. It is not subject to review by a parole board. If the convicted person is sentenced to 5 years in prison, then 5 years is the maximum time they will spend in prison. They might get time off for good behavior, but they will not get parole.

Classes of felony sentences in New York:

1. Class A-I felony: The minimum sentence is 15 to 40 years in prison. The maximum is a life sentence.

2. Class A-II felony: The minimum sentence is 3 to 8 years in prison. The maximum is a life sentence.

3. Class B felony: The minimum sentence is 1 to 3 years in prison. The maximum is no more than 25 years in prison.

4. Class C felony: The minimum sentence is 1 year in prison. The maximum is no more than 15 years.

5. Class D felony: The minimum sentence is 1 year in prison. The maximum is no more than 7 years.

6. Class E felony: The minimum sentence is 1 year in prison. The maximum is no more than 4 years.
