Italian Divorce Law
- In order to get a divorce in Italy, you must qualify under one or more requirements: you and your spouse have legally separated, one spouse has been sentenced for criminal charges, one spouse is a foreign citizen and has obtained a divorce abroad, or the marriage has never been consummated.
- If you are separated from your spouse, you must be separated for at least three years before receiving a divorce in Italy. That time frame begins on the date you and your spouse appeared before Italian court asking for the legal separation.
- The judge presiding over the divorce determines custody, visitation rights and child support. However, either party is allowed to request a review of the judgment at any time.
