How to Appeal Divorce Decrees in Pennsylvania
- 1). Receive by mail the original Notice of Intention to Request Entry of Final Decree (Form 28), Counter-Affidavit (form 29), a photocopy of the Praecipe to Transmit Record (Form 30) as well as the photocopy of the Final Decree (Form 31) by mail from your spouse.
- 2). View the date on the form 28, Notice of Intention to Request Entry of Divorce Decree. It will state "Therefore, on or after..." This date is the deadline you have, which is 20 days from the filing date. You have to work fast if you want to appeal the divorce decree.
- 3). Check either option A or B in the Counter-Affidavit for the reason you want to oppose the entry of divorce decree. Verify that your name and address as well as your spouse's name and address are correct on the form. Verify also that the case number is correct on the form. Fill information out with a black pen, sign and date the form.
- 4). Mail form 29, Counter-Affidavit to your spouse and file one copy at the court house where all filing has taken place. The court will then schedule a hearing for you and your spouse to attend.
- 5). Attend the hearing and voice your reasoning for the appeal. You must attend this hearing of your appeal will be dismissed.
