How to Restart the Divorce Process in Michigan With Kids
- 1). Contact your court clerk regarding the status of your previous case. If you filed for divorce recently, restarting the process may only require filling out a form. If you filed for divorce several months or years ago, you may have to fill out a new packet of forms and pay a filing fee. Provide your previous case information to the clerk and ask for the current case status. If your case is still “active” ask the clerk what you need to do to continue the process. If your case is “inactive” ask the clerk how to restart the process.
- 2). Fill out a new divorce forms packet. If the clerk instructs you to fill out a new or updated packet, complete all forms, including contact, personal, accounts, income and property information for you, your spouse and your children.
- 3). Provide copies of birth and marriage certificates, titles and deeds. Attach the copies to your divorce forms.
- 4). Sign your divorce papers in front of a notary public. If you must have your forms notarized, do not sign them until you meet with a notary public. Although many notaries charge fees, your bank may provide notary services for free as a courtesy to account holders.
- 5). Make copies of your completed, notarized forms. Each court has rules about how many copies you must have to file for divorce. Many form instruction sheets tell you how many copies you need to make. Contact your court clerk if the form instructions are unclear.
- 6). File your divorce papers with the court. Take all copies and filing fees to the court clerk. After review, the clerk will stamp your documents with an official stamp and return your personal copies to you.
- 7). Serve a copy of the filed papers to your spouse. If your spouse agrees to accept the papers, you may qualify for a waiver. Ask your court clerk for details.
