How to File Construction Liens in Kentucky
- 1). Provide a written notice, which provide to the property owner a statement of the amount owed, the date the work was performed or materials supplied, and the intent to hold property liable for the unpaid labor. This notice must be given within 75 days after the last day of work. However, if the property was anything other than a single or double occupancy family dwelling, and the amount in question exceeds $1,000, that deadline is extended to 120 days.
- 2). File a lien statement. Only after notice has been provided can a lien be filed with the county clerk of the county in which the property is located. Liens must be filed within six months from that last day of work. This lien statement must include the amount due, a description of the property, the owner's name, the claimant's name and address, and whether the work was performed by a contract with the owner or with a contractor or subcontractor. If the claimant is a corporation, the name and address of its process agent must be included. All of this information must be in affidavit form and sworn to under penalty of perjury.
- 3). Notify the property owner by mail. Within seven days of filing the lien statement with the county clerk, written notice of the mechanics lien statement must be sent to the property owner via regular mail within seven days of filing the statement with the county clerk. Failure to meet this requirement will result in the lien being dissolved.
