How to Appeal a Divorce

    • 1). Locate and read the rules for appellate procedures for the state where your divorce proceeding took place. The rules can generally be found online, at a local library or at a law school library.

    • 2). Prepare a notice of appeal. In most jurisdictions the notice of appeal must be filed within 30 days of the final order.

    • 3). Pay the required filings fees and other fees associated with an appeal. As a rule, the additional fees will include a fee for the trial court to prepare the record as well as a fee for a court reporter to transcribe the proceedings. These fees will vary by jurisdiction as well as by the length of the transcript.

    • 4). Decide what records and documents you want sent up the appellate court. You will need to inform the trial court shortly after filing the notice of appeal which records, exhibits and documents you want included with the record of appeal.

    • 5). Write and file an appellate brief. The brief summarizes the proceedings at the trial level as well as tells the appellate court what errors you feel the trial court committed in your divorce hearing.
