How to Cancel Credit Card Debt for the Deceased

    • 1). Gather a list of the credit card debts, the amounts and the contact information. Total the amount of the credit card debts so that you can figure out percentages if there is any money left in the estate to cover any additional bills.

    • 2). Call the companies and explain that the person is deceased. You can tell them the date for the probate hearing and that you will be in contact with them at that point. If they request a copy of the death certificate you can forward them a copy.

    • 3). Go through probate court for the estate. The judge will determine how much of each of the debts will be paid. Generally the mortgage is paid for and any items with liens on them are sold. Any remaining money will then go to the estate to pay off the debts.

    • 4). Write a letter to the credit card company explaining the terms set up in probate court. You should include a copy of the official ruling as well as a copy of the death certificate. Explain that the amount that you are sending (if any) will be the last payment, and the rest of the debt should be canceled.

    • 5). Send the letter certified mail with return receipt requested. This allows you to verify that they received the information. Follow up with the companies in a few months to be sure that everything was canceled.
