Indiana School Labor Laws
- The school system of Indiana is governed by the Indiana Code, Title 20 and Title 34-Article 30 laws. This law rules key segments of employment in the education sector including the teachers' conditions of employment, special education provisions and salaries. The 37 articles constituting the school labor laws contain vital guidance on principles which the Indiana Department of Education has adopted in defining employment at schools.
- The Indiana Code, Title 20, "Education," delves into the issues of teacher's contractual arrangements, conditions of employment, cancellation of teacher contracts, and salaries. Title 20, Article 28 embraces teachers' leave of absence, rights, defense service, anti-discrimination policies. Article 28 also discusses crucial topics within the teaching profession such as counseling, legal advice, retirement, unionizing, salaries, compensations, ancillary staff and reasons for termination of teachers' contracts.
- Title 21, "Higher Education," which deals primarily with state colleges and universities, declares on policies regarding professors at state universities--for example, the university faculty oath, hiring procedures, faculty contracts, regulations of conduct, salaries, compensation and benefits.
- Title 34, Article 30--"Civil Law and Procedure: Immunity from Civil Liability," administers the rule relating to school health care professionals and the prohibition of certain nonqualified school personnel to medicate students. This law authorizes only licensed health staff and stipulates the provisions, limitations and immunities of such staff.
- Title 5, Article 10.4-"State Teachers' Retirement Fund: School Corporation Reports and Administration"--lays down the rule about standard contributions, teachers' benefits, penalties, reimbursements, and maintenance of records.
