Plaintiff Sues Merck and Co Over Hair Loss Drug Propecia
A New York plaintiff has filed a lawsuit against Merck & Co., Inc over the hair loss drug Propecia. The plaintiff and his lawyer have framed the charges of negligence, fraud and strict liability over the manufacturer of the drug Merck & Co., Inc.
The plaintiff who was reported as Kamal Nahhas a resident of New York has said in his lawsuit that he started taking Propecia drug at the age of 44 and due to prolonged use of the drug he suffered sexual side effects that are irreversible and permanent. The lawsuit was filed on October 8, 2012 in the United States' District Court for the Eastern District of New York and has leveled counts of charges including, negligence, strict liability, fraudulent, concealment, breach of express and implied warranties and fraud. Asides the plaintiff and his injury lawyer have framed the charges of violation of unfair and deceptive trade practices act, and negligent infliction of emotional distress against the manufacturer.
The co-defendants reported in the lawsuit are Merck Sharpe and Dohme & Dohme Corp. and the plaintiff is seeking punitive, compensatory and exemplary damages from the defendant. With this the plaintiff is also seeking attorney's fees and all the fees that he invested in the treatment.
The plaintiff in his lawsuit said that he started taking Propecia at the age of 44 after he was diagnosed with male pattern baldness. He also added that before taking this drug he never suffered from any kind of sexual dysfunction however he experienced cognitive and sexual dysfunction after prolonged use of the drug.
