    • 1). Read ORS 125.055. This statute discusses what must be in a petition to appoint a guardian. (Find a link in Resources.)

    • 2). Draft the guardianship petition. The petition must include the information required by ORS 125.055. Essentially, include information about the ward or incapacitated adult (such as name, address and the name and address of the person's physician). Additionally, the petition must describe the factual basis supporting a need for a guardianship (such as allegations of abuse or neglect) and list the name of the proposed guardian.

    • 3). Send or hand deliver a copy of the guardianship petition to the court clerk in the Coos County circuit court. Remit a check for the filing fee; to check current filing fees (as they are subject to change) call 541-396-3121.

    • 4). Hire a process server in Coos County to serve notice of the petition to "interested parties." Interested parties include the parent, spouse, or current guardian of the ward or incapacitated adult as well as any other person the court tells you to serve.
