    • 1). If the issue is the non-payment of rent, you must issue a late-payment notice to the tenant before an eviction can take place. Clearly state the amount past due, the delinquency period and the date the notice is being issued. Wait 5 days for the tenant to pay the past due amount, before proceeding with eviction papers if the payment is not made.

    • 2). Provide a written notice of any violation of the terms of the lease regarding care of the property. Clearly identify the problem that needs to be resolved and notify the tenant of the 10-day deadline to correct the problem. If the tenant does not complete the repairs, proceed with eviction papers.

    • 3). If issues with your renter can't be resolved, deliver a written eviction notice to the tenant. Mail the notice to the tenant or post the notice on the door of the rental property. Clearly state that the tenant must vacate the property and why. Provide the tenant with 10 days to move out, if he is on a week-to-week agreement, or 45 days if he is on a month-to-month agreement or lease.

    • 4). File an eviction case with the local court district if the tenant does not vacate the property within the stated time frame. Provide copies of the initial communications as well as the eviction notices served. Include any other documentation you may have.
