Hunting Accidents and Personal Injury

A hunting accident can occur for a number of reasons.
According to the International Hunter Education Association, almost a thousand people in the US and Canada are accidentally shot by hunters every year.
Of those thousand, a little under a hundred of those accidents result in fatalities.
While most of the shooting victims are other hunters, non-hunters have been involved as well.
One of the most common mistakes made by hunters is their misunderstanding their firearm.
Too many accidents are caused by the hunter thinking his gun is empty or the safety is on.
To prevent these kinds of accidents, always know how much ammunition is in your gun at all times and remove any additional ammunition as soon as you're done firing.
Another cause of hunting accidents is simply not pointing the muzzle at the ground while running, walking, or passing your gun.
This may be difficult to remember during all the excitement, but it can easily prevent a potentially deadly accident.
Lastly, to prevent accidents, never have your finger on the trigger before you plan on shooting and always know what your target is before pulling the trigger.
As simple as it may sound, these are very common mistakes and they can lead to injuring or even killing a person.
Always realize you are carrying a deadly weapon.
One final tip is to always wear a brightly colored vest while hunting.
While camouflage works to conceal your attack, it can also make you an easier target.
Bright colors can be seen from a distance and your fellow hunters will know immediately to aim elsewhere.
In most cases a vest won't give you away since most game animals are colorblind.
Most states will treat a hunting accident like a negligence case, but some will consider it a strict liability problem because a loaded firearm is a dangerous weapon.
In any case they will consider the experience of the hunter, how to hunter reacted after the incident and the kind of hunting being done.
In some states, if the victim of the shooting dies, the shooter can be charged with wrongful death and face criminal charges and jail time.
While an accidental shooting seems dangerous enough, hunters also commonly have accidents with tree stands and the condition of the landowner's property.
To ensure your safety while hunting, always wear a harness in a tree stand and make sure you inspect the condition of the property.
Remove any potential hazards to try to prevent injury.
In the event of a hunting accident, you will need to find a personal injury lawyer to help you understand your state laws and how they will affect your case.
