DePuy Orthopaedics has come under intense public scrutiny lately due to problems associated with the DePuy Pinnacle hip replacement. Although there is no recall that was implemented, over 30 DePuy Pinnacle lawsuits have been filed by plaintiffs who claim to have suffered harm from the defective device. At present, the U.S. Food and Drug Administration (FDA) is investigating how Pinnacle devices are causing metal toxicity in recipients.

The purpose of product liability laws is to protect people from harm caused by defective products. Major companies, like DePuy Orthopaedics, are so overly concerned with making a profit that they overlook the safety of their products. Therefore, people get hurt, which forces these companies to take responsibility for their negligence in the form of expensive litigation. In a product liability case in which a person has been injured by a dangerous device or drug, there are different types of damages awarded to return the victim to a state of normalcy similar to before being injured. Recipients of defective Pinnacle devices can get an idea of the damages they will likely receive if they win their potential case against DePuy by considering the different types of awards that are typically granted in product liability cases.

Victims are directly compensated for costs resulting from dangerous products through monetary damages. This "reimbursement" from the company includes past, present, and future medical bills, and applicable property damage. A specific dollar amount may be designated to any loss then reimbursed when the patient claims monetary damages.

Non-monetary damages, in contrast, include losses difficult to define in dollar amounts. The courts may designate a specific dollar amount based on the patient's diminished quality of life resulting from the harm caused by the defective product. A substantial part of the victim's compensation is made up of non-monetary damages, which include physical and emotional pain and suffering, diminished enjoyment of life, loss of friendship or spousal relations, and loss of respect in the community.

Damages that are awarded in order to punish the party found liable for harm are known as punitive damages. Most of the time, however, this award is typically given to a third-party charitable organization and not the victim.

Recipients of the DePuy Pinnacle system that are experiencing pain or any other harmful symptoms may be able to pursue a DePuy Pinnacle lawsuit. DePuy has budgeted as much as $1 billion in the past for those who have been affected by defective devices.
