    Eligibility for Exemption

    • To receive the disabled veteran exemption in Texas, the veteran must have served in the U.S. armed forces, and the U.S. Department of Veterans Affairs (VA) must classify the veteran as disabled.

    Eligibility for 100-Percent Exemption

    • In addition to the above, the veteran must be receiving 100 percent disability pay from the VA and must also have either a rating of 100 percent disability from the VA or be classified as unemployable. In addition, the veteran needs to own a home in Texas as his primary residence.

    Exemption Amounts -- Any Property

    • For veterans who have some level of disability, the exemption amount is related to the veteran's disability rating. With disability ratings ranging from 10 percent to 100 percent, the exemption amounts vary from $5,000 from the value of the property to $12,000. This exemption can be applied to any one property that the veteran chooses.

    Exemption Amount -- Homestead

    • For veterans with a 100-percent disability rating, or who are classified as being unemployable, the exemption is 100 percent for property defined as the veteran's primary homestead.

    Obtaining the Exemption

    • For veterans with less than 100 percent disability or who are wanting an exemption on property that is not their primary residence, the application form is available at the Texas comptroller's Window on State Government website (see Resources).

      For the 100-percent homestead exemption, applications must be filed with the chief appraiser of the district in which the property is located, using Form 50-764, Application for Residence Homestead Exemption for Disabled Veteran with 100 Percent Disability. If needed, assistance can be obtained by calling the comptroller's office at 800-252-9121 or by selecting your county office's website from the comptroller's district directory (see Resources). Attach to the form documentation that the veteran is receiving 100 percent disability pay plus the 100 percent disability rating or that the veteran is unemployable.
