    • 1). Talk to the person in charge of issuing paychecks at your company. It's possible that if the deduction was a mistake, you can get the money back by simply alerting them of it. For example, if you are normally supposed to have $100 garnished, but you were garnished of $150, if you catch the mistake before the garnishment is sent, you may be able to retrieve the overage.

    • 2). File a financial disclosure with the court that ordered the wage garnishment. Because only 25 percent of your disposable income can be garnished, you can request to receive back any overpayments that are made after you prove that too much is being taken. In the case of child support, up to 50 percent may be garnished if the employee is supporting a spouse and child and 60 percent, if they are not.

    • 3). Request a court hearing. If too much is being taken out of your check, request a hearing to reevaluate the amount being taken. If the previous amount taken out was a mistake, you can request it be returned. However, you may only succeed in getting the garnishment order changed and not necessarily receive money back.
