How to File a Hardship When Being Garnished
- 1). Gather all the financial information you have. Form arguments about why being garnished is a hardship, and back them up with documents.
- 2). Contact the agency garnishing your wages. Ask what forms and information you need to provide, which will vary based on your circumstances and the agency involved. The IRS, state departments of revenue, the Department of Education and private lenders each have different processes.
- 3). Go to the clerk of the court that ordered the wage garnishment if it results from a judgment against you. Fill out a form requesting a hearing to determine the extent of your hardship (if any) and if your garnishment should be reduced or eliminated.
