How to File Property Forms for a Divorce
- 1). Obtain the required forms from the court where the divorce has been filed. You may either get the forms in person or on the website, if available. Do a web search for the divorce in the county and state where you reside and that should take you to the appropriate court.
- 2). Complete the form with the required information. If you are listing assets, such as a house, you should list the fair-market value of the property and do not make any deduction for an outstanding mortgage. Specify how the property is titled under the heading of owner. An example would be John and Mary Smith, Joint Tenants or Tenants by the Entirety.
- 3). List all liabilities. This is who you owe money to and how much it is. You should also indicate under whose name the debt is in, even though it may be considered marital debt.
- 4). List any life insurance policies and their cash value. You can get the cash value from the insurance company by calling their customer service. It is the cash value that may be divided, not the death benefit.
- 5). Review the forms for accuracy. Often the forms must be notarized and if that is the case make certain that you have them notarized before delivering them to the court.
