Consumer protection act 1986 is specially meant for customers, consumer's interest and to resolve their grievances. Unfair trade practices are increasing day by day. Unfair trade practice provider exploits customers harassed them and cheat them.
There are many sellers who are practicing unfair trade practices whether they are banks, airline services, telecom companies, hospitals, insurance companies, and etc. despite of knowing importance of customers in a market. They are playing with customer emotions by cheating them and exploiting them.
Unfair practices can be in any way by misrepresenting, misleading customers, charging more than market price, selling defective goods and etc. just for the sake of extra profit they are exploiting customers.
Due to above situation consumer protection act was established. This act lays down all the necessary rights, law and rules to protect customers. Consumer rights in consumer protection act protect customer in every aspects. This act not only protects them from unfair trade practices but also redresses their grievances and educates them about their rights.
Many of us don't have any idea about our rights. And if we have any clue we barely use them. Rights under the consumer protection act makes customers more independent and strong. This act redresses consumer complaints with the help of the three tier structure.
Three tier structures is district forum, every district consist district forum. This court considers those cases which are costing below 20 lakh. At present there are 64 district forums. State commission known as state consumer disputes redressal commission. Ever state has its own commission. At present there are 35 state commissions. State commission considered those cases which are above 20 lakhs and below 1 crore. The national consumer disputes redressal commission considered those case which are above 1 crore. There is only one national commission which is situated in Delhi
This three tier structure and rights for customer give complete protection. customer can approach in any of these courts regarding customer problems. These courts are fast track courts resolving consumer grievances quickly.
If consumer is not satisfied with the decision then he/ she can further approach. The consumer is not satisfied with the district forum then he can approach to state commission and if the consumer is not satisfied with the decision of state commission than he/she can further approach in national communication.
Consumer courts can relief grants-
- Repair defective product
- Replace defective product
- Refund the price of the product and services
- Compensate the amount of loss suffered by consumers
- To remove a deficiency in services
- Withdrawal of goods and services which are hazardous to life
- To strop practicing unfair trade practices
These are some of relief grants by the consumer forum. Though there are many more acts regarding protecting consumer's interest but this act has worked a lot efficiently and effectively.
