How to Challenge CHP Police Reports
- 1). Obtain an official copy of the report in question. Complete CHP Form 190, available at CHP offices or on the agency's website, and mail it to the CHP office that prepared the report or take it there in person. For most reports, you will have to pay a $10 fee.
- 2). Contact the office where the report originated and ask to speak to the supervisor of the officer who prepared the report.
- 3). Explain your objections to the supervisor and ask whether the report can be corrected or amended. In the case of information that was incorrect or overlooked, this may be a simple matter. If you are challenging the findings of an accident investigation, it will probably be difficult to get the report changed.
- 4). Contact your attorney or your insurance agent and explain the information or conclusions that you are challenging in the CHP report. A police report is not necessarily the final word on an incident.
- 5). Contact the CHP internal affairs office if you believe the report was deliberately falsified. Remember that simply disagreeing with an officer's interpretations or conclusions is not a valid basis for a complaint. The internal affairs office investigates only deliberate acts of misconduct.
