How to Do a Homestead in Massachusetts
- 1). Talk with a lawyer or other legal counsel about the benefits of homesteading your primary residence. Only one person can file a homestead on a property, but the property is protected against liens or lawsuits filed against spouses or children who make the residence their primary residence.
- 2). Pick up a Declaration of Estate of Homestead form at most Registry of Deeds offices or at a legal stationery store or your attorney's office. Forms for mobile homes are available at your town clerk's office.
- 3). Fill out the form completely. Forms are not complicated, but all questions must be answered, including the property title numbers and location. All forms must be signed in front of a Notary and duly notarized.
- 4). Return the form to the Registry of Deeds office in the county in which the property is located, along with a check made payable to the Commonwealth of Massachusetts. Consult your local Registry of Deeds for the exact cost of registering your homestead.
