The time right after a car accident is full of a flurry of activity for everyone involved.
There are decisions that must be made and typically there is not much time to make them in because some of the matters involved need to be acted on as soon as possible.
On top of that, if there are injuries involved then the person or people who have been injured may not have the ability to get everything done that needs to be done so that they can get a claim filed in enough time to ensure that the negligent person will take care of their responsibilities.
One of the decisions that will need to be made concerns whether or not there will be a need to hire a personal injury lawyer in order to assist them with their claim.
In order to make an informed decision, here is a quick look at what this type of attorneys do.
Right After the Accident In the time right after a car accident, the attorney's goal will be to gather the facts of the accident and to make certain decisions based on those facts.
The client and the attorney will have a conversation where the attorney will ask a variety of questions.
The way these questions are answered will determine:
  • Is the client at fault and if so, how much of that fault lies with the client?
  • Who is ultimately responsible for the accident occurring?
  • If a claim is pursued, will it stand up in court?
  • What are the current damages to the victim and what damages are yet to come?
Once the attorney has gotten a fair grasp on the accident and the circumstances involved, he will determine if it is in the client's best interest to pursue a claim and if so, how much of a settlement they might get.
The attorney will then have a conversation with the claimant and advise them of all of the options that are available.
If the decision is to file the claim then the attorney will do that.
Filing a Claim Once the decision is made to file a claim, the attorney will make sure that they file all documents within the deadlines that have been set forth.
There are statutes of limitations for this sort of thing and an attorney is better prepared and able to do this than most victims.
Court If the insurance company does not want to settle or wants to settle for an amount that is less than what it should be then the attorney will advocate for the client in court.
In court, most of the time the insurance companies will try to pass off the fault of the accident to the victim.
The attorney can present the facts and make sure that justice is served.
In short, the job of this type of attorney is to protect the victim and make sure that they receive the compensation that they really deserve as opposed to being left to foot the bill for everything.
